Your local criminal defense attorney will be able to evaluate the facts of your case and determine that it is more beneficial for a judge to hear the facts. Your attorney will know the judges tendencies. The burden of proof on the state is the same as in a jury trial, beyond a reasonable doubt. Bench trials are typically shorter in duration than a jury trial.
