Probable Cause
Probable cause is the standard by which a police officer has the authority to make an arrest, conduct a personal or property search, or to obtain a warrant for arrest. If the police officer does not have probable cause for an arrest or a search, any evidence that flows from the illegal stop or search will be suppressed. Many attorneys will file motions to quash arrest. If your attorney is successful, the state will be unable to present any evidence at trial resulting from the quashed stop or search.
The Fourth Amendment of the Constitution states as follows:
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
This principal is the bedrock of keeping the United States from becoming a police state. These restrictions ensure that we live our lives free from any harassment from the police.
